ERA Media Release - Mr Ali Jan

On Wednesday 3rd July 2019, the ERA Appeal Panel adjudicated on the appeal lodged by Mr. Ali Jan in regards to the severity of penalty given by the Stewards for the following breaches;
• That he received a 12 month disqualification pursuant to ERA Rule 95AAA 2, that he presenting REBEL STREAK (GB) to race in Race 5 “The Zabeel Trophy Rated Conditions 75+” over 1600 metres at Meydan Racecourse on Friday 5th April 2019, which was subsequently found, upon analysis of a pre-race urine sample, to have had cobalt administered to it, as evidenced by a concentration of cobalt in excess of 100 micrograms per litre in urine; and
• That he received a 6 month disqualification pursuant to ERA Rule 95AAA 9, that he administered a paste to REBEL STREAK (GB), namely Bioactive Booster, prior to the gelding racing at Meydan on Friday 5th April 2019.

Having read and heard the submissions of Mr. Jan and of Mr. Samuel Shinsky on behalf of the Stewards, the Appeal Panel determined that the appeal against both decisions failed.

The Appeal Panel orders that:
(i) 12 month disqualification period for the breach of ERA Rule 95AAA 2 shall stand;
(ii) 6 month disqualification period for the breach of ERA Rule 95AAA 9 shall stand;
(iii) That the 12 month disqualification period shall commence at midnight Thursday 4th July 2019, and end at midnight Saturday 4th July 2020; and
(iv) That the 6 month disqualification period shall commence at midnight Thursday 4th July 2019, and end midnight Saturday 4th January 2020.
