ERA Media Release - Mr Saeed Al Shamsi

The ERA Stewards opened an inquiry on 2nd of April, 2019 into the notification by the Dubai Equine Forensic Unit that the prohibited substance Trometamol had been detected in the post-race urine sample taken from SWORD OF TRUTH (IRE), after it raced in, Race 1 “Arabian Adventures Maiden” over 1950m at Jebel Ali Racecourse on the 8th of February 2019.

Evidence was taken from Mr. Saeed Al Shamsi (Trainer), Dr. Kieran Finn (ERA Regulatory Veterinarian) and Mr. Jahfar Nalakath (Chief Analyst – Dubai Equine Forensic Unit). The following matters were established during the inquiry;
1. On Sunday 17th February 2019, the ERA Stewards were advised of the irregularity to Trometamol in respect to the post-race urine sample taken from SWORD OF TRUTH (IRE).
2. On Wednesday 20th February 2019, Mr. S Al Shamsi was notified of the irregularity in the sample taken from SWORD OF TRUTH (IRE) via an official stable visit at his Al Shahama Stables.
3. On Wednesday 20th February 2019, Mr. S Al Shamsi advised that he wished to exercise his right to have the reserve portion of the sample analysed by another accredited racing laboratory in accordance with ERA Rule 95D(ii).
4. On Friday 22nd March 2019, the ERA Stewards received confirmation from LGC Limited (UK), that the presence of Trometamol was detected in the “B” urine sample from SWORD OF TRUTH (IRE).
5. Mr. S Al Shamsi could offer no explanation throughout the inquiry, as to how the Trometamol was found in the sample taken from SWORD OF TRUTH (IRE).
6. Evidence was tendered that Trometamol acts as a buffering agent and is a diuretic. Further at the levels detected within SWORD OF TRUTH (IRE), it was estimated that the Trometamol would have been given within 24 hours of racing.

Trainer Mr. S Al Shamsi pleaded guilty to a charge under the provisions of ERA Rule 95AAA 2, in that he presented and raced SWORD OF TRUTH (IRE) at Jebel Ali Racecourse on the 8th of February 2019, when the post-race urine sample taken from that gelding, upon analysis, was found to have had administered to it Trometamol, a prohibited substance under the ERA Rules.

In determining the appropriate penalty in this case, the Stewards considered a number of factors including:
• The circumstances of the offence;
• Nature of the substance;
• General and specific deterrence;
• The integrity and image of racing in the UAE;
• Mr. S Al Shamsi’s forthright evidence and co-operation throughout the inquiry;
• Mr. S Al Shamsi’s guilty plea and record in relation to the prohibited substance rules (see below).

Mr. S Al Shamsi was fined the sum of AED 30,000.

Pursuant to ERA 86(ii), SWORD OF TRUTH (IRE) was disqualified from fourth place in Race 1, “Arabian Adventures Maiden” over 1950m at Jebel Ali Racecourse on the 8th of February 2019:

Mr. S Al Shamsi’s record in relation to prohibited substance:
• No prior breaches since holding a Trainers license from October 2014.

Relevant Rules:
ERA 86(ii) – Where any declared runner has been the subject of an examination under the Rules 8(vi) and or (vii) and has been found to have received a Prohibited Substances, the Horse shall be disqualified from the Race and from other Races as the ERA determines.

ERA Rule 95AAA 2 – Any Trainer or other Person in charge of a Horse, which is presented to Race or performed a Test, or has Raced or performed a Test which is found (upon analysis) to have had administered to it a Prohibited Substance, shall be liable to a Penalty.

ERA Rules 95D(ii) – Upon the detection by an Accredited Racing Laboratory of a Prohibited Substance in the Sample from a Horse, such laboratory shall notify its finding to the Stewards, who shall then notify the Trainer of the Horse of such finding and give him the option to have the reserve portion of the Sample Tested at another ERA-approved Accredited Racing Laboratory. The Trainer will have 3 days to notify the Stewards of such requirement. A refusal by the Trainer to Test the reserve portion of the Sample shall not prevent the Stewards from having the reserve portion of the Sample Tested.
