ERA Media Release - Mr Satish Seemar

The ERA Stewards opened an inquiry on Tuesday 17th of December 2019, into the notification by the Dubai Equine Forensic Unit that the prohibited substances Acepromazine and 2-(1-Hydroxyethyl) Promazine Sulphoxide had been detected in the post-race urine sample taken from CACHAO (GB), after it raced in, Race 2 “Gulfnews.com Handicap” over 1600m at Meydan Racecourse on Thursday 7th of November 2019.

Evidence was taken from Mr. Satish Seemar (Trainer), Mr. Bhupat Seemar (Assistant Trainer), Mr. Patrick McWilliams (Head Lad), Dr. Kieran Finn (ERA Regulatory Veterinarian) and Dr. Michael Subhahar (Chief Analyst – Dubai Equine Forensic Unit). The following matters were established during the inquiry;
1. On Monday 18th November 2019, the ERA Stewards were advised of the irregularity to Acepromazine and 2-(1-Hydroxyethyl) Promazine Sulphoxide in respect to the post-race urine sample taken from CACHAO (GB).
2. On Wednesday 20th November 2019, Mr. S Seemar was notified of the irregularity in the sample taken from CACHAO (GB) via an official stable visit at his Zabeel Stables. Mr. Seemar stated that CACHAO (GB) does receive regular Acepromazine orally in a tablet form. The last administration of Acepromazine to CACHAO (GB) prior to the race was on Tuesday 29th October 2019, being 8 clear days.
3. On Wednesday 20th November 2019, Mr. S Seemar advised that he wished to exercise his right to have the reserve portion of the sample analysed by another accredited racing laboratory in accordance with ERA Rule 95D(ii).
4. On Tuesday 12th December 2019, the ERA Stewards received confirmation from the Hong Kong Jockey Club, that the presence of Acepromazine and 2-(1-Hydroxyethyl) Promazine Sulphoxide was detected in the “B” urine sample from CACHAO (GB).
5. Evidence was tendered that Acepromazine is a sedative that is commonly used within racing stables. It is primarily used as a chemical restraint in hyperactive or fractious animals, as it has a strong sedative effect.
6. Mr. S Seemar could offer no explanation for CACHAO (GB) returning a positive sample to Acepromazine and 2-(1-Hydroxyethyl) Promazine Sulphoxide

Trainer Mr. S Seemar pled guilty to a charge under the provisions of ERA Rule 95AAA 2, in that he presented and raced CACHAO (GB) at Meydan Racecourse on Thursday 7th of November 2019, when the post-race urine sample taken from that gelding, upon analysis, was found to have had administered to it Acepromazine, a prohibited substance under the ERA Rules.

In determining the appropriate penalty in this case, the Stewards considered a number of factors including:
• The circumstances of the offence;
• Nature of the substance;
• General and specific deterrence;
• The integrity and image of racing in the UAE;
• Mr. S Seemar’s forthright evidence and co-operation throughout the inquiry;
• Mr. S Seemar’s guilty plea and record in relation to the prohibited substance rules (see below).

Mr. S Seemar was fined the sum of AED 40,000.

Pursuant to ERA 86(ii), CACHAO (GB) was disqualified from second place in Race 2, “Gulfnew.com Handicap” over 1600m at Meydan Racecourse on Thursday 7th of November 2019:

Mr. S Seemar’s record in relation to prohibited substances:
• 2nd November 2001, was fined AED 12,000 for a positive sample to Boldenone to ARCHBISHIP (US) after racing at Jebel Ali.
• 3rd January 2015, was fined AED 15,000 for a positive sample to Meloxicam, Furosemide and Phenylbutazone after completing an official test.

Relevant Rules:
ERA 86(ii) – Where any declared runner has been the subject of an examination under the Rules 8(vi) and or (vii) and has been found to have received a Prohibited Substances, the Horse shall be disqualified from the Race and from other Races as the ERA determines.

ERA Rule 95AAA 2 – Any Trainer or other Person in charge of a Horse, which is presented to Race or performed a Test, or has Raced or performed a Test which is found (upon analysis) to have had administered to it a Prohibited Substance, shall be liable to a Penalty.

ERA Rules 95D(ii) – Upon the detection by an Accredited Racing Laboratory of a Prohibited Substance in the Sample from a Horse, such laboratory shall notify its finding to the Stewards, who shall then notify the Trainer of the Horse of such finding and give him the option to have the reserve portion of the Sample Tested at another ERA-approved Accredited Racing Laboratory. The Trainer will have 3 days to notify the Stewards of such requirement. A refusal by the Trainer to Test the reserve portion of the Sample shall not prevent the Stewards from having the reserve portion of the Sample Tested.
